உறுப்பினர்களின் தகுதி நீக்கம் தொடர்பான கேள்விகளின் மீதான முடிவு

(1) ஒரு மாநில சட்டமன்றம் அல்லது சட்டமன்ற மேலவையின் உறுப்பினர், கட்டுரை 191(1)-ல் குறிப்பிடப்பட்டுள்ள தகுதி நீக்க காரணங்களில் ஏதேனும் ஒன்றிற்கு உட்பட்டவராகிவிட்டாரா என்ற கேள்வி எழுந்தால், அந்தக் கேள்வி மாநில ஆளுநரின் முடிவிற்காக அனுப்பப்பட வேண்டும். ஆளுநரின் முடிவு இறுதியானதாக இருக்கும்.

(2) இத்தகைய கேள்வி தொடர்பாக எந்த முடிவையும் எடுப்பதற்கு முன், ஆளுநர் தேர்தல் ஆணையத்தின் கருத்தைப் பெற வேண்டும். மேலும், அந்தக் கருத்தின்படியே செயல்பட வேண்டும்.

மாநில சட்டமன்ற உறுப்பினராகத் தேர்ந்தெடுக்கப்படுவதற்கும், உறுப்பினராகத் தொடர்வதற்குமான தகுதி நீக்கங்கள்

(1) ஒரு நபர் மாநில சட்டமன்றம் அல்லது சட்டமன்ற மேலவையின் உறுப்பினராகத் தேர்ந்தெடுக்கப்படுவதற்கும், உறுப்பினராக இருப்பதற்கும் தகுதியற்றவராவார், அவர்:

(அ) இந்திய அரசாங்கம் அல்லது முதல் அட்டவணையில் குறிப்பிடப்பட்டுள்ள ஏதேனும் மாநில அரசாங்கத்தின் கீழ் இலாபம் தரும் பதவியை (Office of Profit) வகித்தால்; ஆனால், அந்தப் பதவி தகுதி நீக்கத்தை ஏற்படுத்தாது என்று மாநில சட்டமன்றம் சட்டத்தின் மூலம் அறிவித்திருந்தால் இது பொருந்தாது.

(ஆ) தகுதியான நீதிமன்றத்தால் மனநிலை பாதிக்கப்பட்டவர் (Unsound Mind) என அறிவிக்கப்பட்டிருந்தால்.

(இ) கடன் தீர்க்கப்படாத திவாலான நபராக (Undischarged Insolvent) இருந்தால்.

(ஈ) இந்தியக் குடிமகனாக இல்லாவிட்டால், அல்லது தன்னார்வமாக வேறு நாட்டின் குடியுரிமையைப் பெற்றிருந்தால், அல்லது வெளிநாட்டிற்கு விசுவாசம் செலுத்துவதாக ஏற்றுக்கொண்டிருந்தால்.

(உ) நாடாளுமன்றம் இயற்றிய ஏதேனும் சட்டத்தின் கீழ் தகுதி நீக்கம் செய்யப்பட்டிருந்தால்.

விளக்கம்: மத்திய அமைச்சர் அல்லது மாநில அமைச்சர் பதவியில் இருப்பது மட்டும், இலாபம் தரும் பதவியை வகிப்பதாகக் கருதப்படாது.

கட்டுரை 191(2)

ஒரு நபர், அரசியலமைப்பின் பத்தாவது அட்டவணை (கட்சித் தாவல் தடுப்புச் சட்டம் / Anti-Defection Law) கீழ் தகுதி நீக்கம் செய்யப்பட்டிருந்தால், அவர் மாநில சட்டமன்றம் அல்லது சட்டமன்ற மேலவையின் உறுப்பினராக இருப்பதற்குத் தகுதியற்றவராவார்.

Decision on questions as to disqualifications of members

(1) If any question arises as to whether a member of a House of the Legislature of a State has become subject to any of the disqualifications mentioned in clause (1) of article 191, the question shall be referred for the decision of the Governor and his decision shall be final.
(2) Before giving any decision on any such question, the Governor shall obtain the opinion of the Election Commission and shall act according to such opinion.

Article 191 in Constitution of India

(1) A person shall be disqualified for being chosen as, and for being, a member of the Legislative Assembly or Legislative Council of a State
(a)
if he holds any office of profit under the Government of India or the Government of any State specified in the First Schedule, other than an office declared by the Legislature of the State by law not to disqualify its holder;
(b)
if he is of unsound mind and stands so declared by a competent court;
(c)
if he is an undischarged insolvent;
(d)
if he is not a citizen of India, or has voluntarily acquired the citizenship of a foreign State, or is under any acknowledgement of allegiance or adherence to a foreign State;
(e)
if he is so disqualified by or under any law made by Parliament.
Explanation. For the purposes of this clause, a person shall not be deemed to hold an office of profit under the Government of India or the Government of any State specified in the First Schedule by reason only that he is a Minister either for the Union or for such State.
(2)
A person shall be disqualified for being a member of the Legislative Assembly or Legislative Council of a State if he is so disqualified under the Tenth Schedule.
